环境保护:海外投资者面临的法律问题

Abstract

随着国际社会对海外投资导致的环境污染问题的重视,海外环境的保护成为投资者面临的一个重要法律问题。目前,投资者对于海外投资的环境保护,承担着具有规范作用的国际软法义务和表现为东道国及母国政府规制的间接国际硬法义务。东道国政府法律规制可能引起的国际争端以及环境侵权引起的国际诉讼表明,对海外投资的环境保护具有重要的现实意义。中国政府和海外投资者应注意对海外投资环境的保护。

As the international community pays more attention to environmental pollution caused by overseas investment,overseas environmental protection is becoming a legal issue faced by overseas investors.At present,there are not only international soft laws that can play a normative role,but also indirect international hard laws enacted by the host country and the home country,providing obligations for investors to observe for overseas environmental protection.The international disputes likely to be brought about by relevant laws in host countries and the international litigations resulting from environmental torts of overseas investors have pointed to the environmental protection on the part of overseas investors.It is,therefore,imperative that the Chinese government and overseas investors pay special attention to overseas environmental protection.
