A Review Concerning 2009 Maritime Delimitation in the Black Sea

Ukraine case. In this case, the ICJ confirmed the “equitable principles and relevant circumstances approach” and applied the equidistance method to delimitation. Meanwhile, the ICJ insisted that although the equidistance method should be a primary provisional step for delimitation, it did not demonstrate that the method shall take priority automatically, and that the method shall not apply if there were compelling reasons. As for the effectivites of Serpents' Island in the delimitation, the ICJ defined Serpents' Island as a rock rather than an island, which reflected the recent tendency in maritime delimitation. However, Ukraine was not satisfied with the ICJ Judgment, which demonstrated that there were still some problems with this tendency.
