On the Temporary Identification Standards of Origin Under ECFA

【中文摘要】作为实施“早期收获计划”的一项基础性工具，《海峡两岸经济合作框架协议》(ECFA) 临时原产地规则认可的基本标准虽然多元，但在实际运用中一般以简明的CTC、CTC加VC为主； 而在辅助标准方面，则选择性地纳入了累积条款、微量条款等通行规则。ECFA“早期收获计划”实施以来，两岸企业尤其是台湾企业申请原产地证书踊跃，但也存在一些问题。未来《两岸货品贸易协议》项下的原产地认定标准的设计，既应遵循国际惯例也应体现两岸特色，既应重视经济功能也不可完全忽略非经济功能，并在偏向宽松与趋于严格中寻找最佳的平衡。 【Abstract】 As a fundamental tool to implement the “Early Harvest Plan” (EHP) , some basic criteria recognized by the temporary identification standards of origin under the framework of The Economic Cooperation Framework Agreement (ECFA) are plural,but in practice, the concise CTC and CTC+VC are generally used as the main identification standards. Such universal rules as the accumulation rule and De Minimis are selectively adopted as the supplementary standards.Ever since the implementation of ECFA's EHP, enterprises on both sides of the Strait，especially those from Taiwan，have applied enthusiastically for certificates of origin. However，there are still some problems. Therefore，this paper argues that the future design of the origin criteria under"The Cross-Strait Goods Trade Agreement” should follow the international practice，and at the same time reflect the characteristics of both sides of the Strait. Besides，it should attach importance to its economic function without ignoring its non-economic function. Meanwhile，efforts should also be made to seek the best balance in favor of its loosenes and strictness.
