Transition of the Death Penalty of the Offender's Three Zu in the Early Han Dynasty
【Abstract】The death penalty imposed on the offenders three zu, i, e, his whole family and the families of his mother and wife, inherited from the Qin Dynasty, was abolished in the first year of Empress Lü(187 B. C. ) ; It was reenacted in the eighth year of Empress Lü (180 B. C. ) , after her death; It was again abolished in the first year of Emperor Wen (179 B. C. ) and was reenacted from the first year to seventh year of Emperor Wen's Hou-yuan period (163 B. C. -157 B. C.). The abolition of the penalty had been argued over ever since the Warring state period, and the national policy of the Han Dynasty was to remove severe laws of the Qin Dynasty. These existed as a background for the abolition . On the other hand, the reenactment of the penalty was caused by getting a renewed understanding of its intimidating effect as a penalty for coups detat and the high treason cases.
