dc.description.abstract【中文摘要】对我国远洋渔船行政处罚权的分配及罚款数额的确定,是渔业行政 管理中需要解决的重要问题之一。本文根据不同的情形分析了我国远洋渔船行政处罚权的分配问题,并在此基础上指出,“一事不再罚”原则并不适用这种情况, 但行政处罚权的享有并不意味要对远洋渔船进行再次完全处罚,而应考虑多种因 素对违反我国远洋渔业行政管理秩序的远洋渔船的罚款数额的影响。 【Abstract】The distribution of administrative penalty power and the determination of the fine amount on the pelagic fishing vessels of China is a crucial matter in fisheries administration. This article analyzes the problem of punishment power distribution in various situations, and proposes on such basis, that the principle of “prohibition against double jeopardy” does not apply to pelagic fishing vessels. However, the entitlement to punishment power does not implicate that additional penalty must be fully imposed on the pelagic fishing vessels; rather, different factors shall be considered when examining their impact on the fine amount imposed on the pelagic fishing vessels breaching fisheries administrative order of China.zh_CN
