| dc.description.abstract | 海事确权诉讼是《中华人民共和国海事诉讼特别程序法》第十章“债权登记与受偿程序”的一个重要环节,但由于法律及相关司法解释的规定较为简陋，导致司法实践中存在诸多问题，为此,讨论海事确权诉讼在审判实践中存在的问题具有重要的现实意义。 本文包括前言、正文、结论三部分。正文分为三章。 第一章，海事确权诉讼的法律属性。第一节，从确权诉讼的内涵出发，阐述了其定义、特点及我国对于确权诉讼的立法。第二节，按民事诉讼理论中诉的分类，分别介绍了给付之诉、确认之诉和形成之诉的概念。对理论上关于确权诉讼性质的不同观点进行了阐述。通过对不同观点逐一进行分析，得出确权诉讼应为给付之诉。 第二章，海事确权诉讼的管辖和审... | |
