银行收费问题的合法性研究

Abstract

“银行收费”的法律实质是银行与客户之间的权利义务关系，即银行对其提供的金融服务享有向客户收费的权利，客户因接受银行提供的服务负有缴费的义务。“银行收费”问题在现行的法律框架下，引起了诸多争论。因此，对其相关的法律问题进行研究并提出相应建议有着非常重要的理论与实践意义。银行收费问题学者多从经济学与社会学角度加以研究，而从法律视角的分析却很少。本文紧紧围绕银行收费问题这个核心，除了前言和结束语外共分四章：第一章：以案例引出银行收费问题，从银行收费的现状分析，概括出银行收费的四个重要特点，即收费项目逐年增多、各大银行收费有序“合谋”、垄断经营下的强势收费、法律法规不健全。第二章：从成本效益原则因素、...
