司法过程中的法律解释

Abstract

内容摘要 法律必须是确定的，却又不能静止不变。为了实现安全、可预见的社会生活，法律必须是确定的，而为了迎合当前社会的需要，法律又必须是发展的。强调确定而忽视变化会导致法律的蜕化，而强调发展而忽视确定则会导致无政府主义。因此，随着社会的发展而发展是法律的生命之所在。纵观法律发展的历史，无论是立法还是法律解释，都旨在于使法律适应社会变化的需要。本文在对比立法和法律解释这两种法律发展途径，认为法律解释更能够平衡法律的确定性和社会需要之间的矛盾。因此对我国现有的法律解释制度进行分析，在此基础上提出完善建议就成为本文的写作目的。 第一章主要通过对法律语言的模糊性、法律漏洞的存在与社会生活的多样性等影...
