Abstract
罗马法中客服设施经营人的承保责任(下简称“承保责任”)是指经营人对旅客随身携带的物品的安全所承担的客观责任。它起源于公元前2世纪的裁判官告示,经过诸多法学家的解释得到了丰富与发展,并由优士丁尼《国法大全》编纂者收录于罗马法古典文本。它是诸多现代制度的雏形,得到了诸多国家、地区法律以及国际公约的承袭与发展。 本文首先讨论承保责任的含义,一方面从实体法的规定分析承保责任的语义;罗马法古典文本中裁判官、法学家及罗马皇帝对承保责任的详细规定;以及涉及的相关法律理论。另一方面从程序法的规定讨论四种诉讼的关联、诉讼的具体规则。 其次,围绕承保责任的核心问题,即归责原则展开讨论。第一点是分析承保责任的进...
