不正常航空运输中承运人民事责任研究
The Research of Carrier’s Civil Liability under Irregular Flight
摘要
民航运输作为一种高投入、高风险、低收益的产业，已经成为大众化的出行方式。近年来民航运输中航班不正常情况多发，且伴随着《航班正常管理规定》的出台，民航局对承运人在航空不正常运输中的服务、保障能力提出严格要求。本文从不正常航空运输的内涵谈起，着重对我国不正常航空运输的类型、法律适用问题进行研究，指出当前存在的行业法律欠缺问题，然后通过对美国、欧盟等发达国家及地区的不正常航班承运人民事责任进行比较提出完善对策。 针对论题，以阐述不正常航空运输中承运人民事责任为主线，从2017年起施行的《航班正常管理规定》存在哪些立法创新以及未明确的损害赔偿责任谈起，结合国内其他民航规章，通过比较研究美国、欧盟等发...
