An Empirical Study on the Law Application of Taiwan-related Civil and Commercial Cases

实证研究表明,大陆法院涉台民商事案件法律适用存在冲突规范普遍任意适用、台湾法适用比例低、重要法律依据缺失、适用大陆法的案件冲突法援引不规范、法律选择证立缺失或不充分等问题。但大陆法院涉台民商事案件法律适用也呈现出积极面相：2011年1月1日台湾法适用在立法（司法解释）层面解冻后,大陆法院开始在涉台民商事审判中适用台湾法裁判;大陆法院台湾法适用和查明具有法律选择证立规范、法院在台湾法查明中发挥积极作用、通过两岸司法互助途径和委托专家查明台湾法等方式得到积极尝试等特点。The empirical study shows that the mainland＇s law of the Taiwan-related civil and commercial cases is applicable to the arbitrary application of conflict norms, the low application rate of Taiwan law and the lack of important legal basis. In addition, the citation of legal case conflict norms applicable to the mainland law is not standardized and the proof of law choice is insufficient. However, the law application of Taiwan-related civil and commercial cases has presented positive features. Some mainland courts have begun to apply Taiwan law in the Taiwan-related civil cases since the application of Taiwan civil law was allowed on January 1,2011. The Taiwan law＇s application and identification approved by mainland＇s court has its choice of law justification standard, and the court plays an active role in the identification of Taiwan law. Meanwhile, the way to investigate Taiwan law through the cross-Strait mutual legal assistance and commission experts enjoys a positive try.
