Bad Person and Good Person Provided by the General Provisions of Civil Law

从罗马法中挖掘出其潜藏的敌人刑法和敌人民法理念,把它与时下流行于欧美的敌人刑法理论和敌人民事立法贯通,引入我国的民法理论并挖掘我国既存的敌人民法或坏人民法实践,反推出好人民法理论,进而发展出好法人和坏法人理论,将之与坏人民法理论打包,用来分析《民法总则》规定的主体的道德类型,进而得出好人和坏人不可能平等的结论。We explore the hidden concepts of criminal law for enemy and the civil law for enemy in Roman law, combine them with the theory of criminal law for enemy and of civil law for enemy that are prevalent in Europe and the United States now, and introduce them into our country＇s civil law theory and excavate the practice of civil law for enemy or for bad person existing in our country. Furthermore, we can formulate the theory of civil law for good person and the theory of good legal person and bad legal person. With the package of concepts of civil law for good person and for bad person, we can analyze the moral types of the subjects provided for in the General Provisions of Civil Law, and conclude that good person and bad person cannot be equal.
