Application of interest balancing method in judging the legitimacy of video ad-blocking behavior

在屏蔽视频广告行为的正当性判定中，商业道德具体化的裁判路径始终无法给以透彻的说理，而利益衡量方法强调对案件事实的实质性判断，可有效弥补法律漏洞，并且其在适用中更具可操作性，故可作为行为正当性判定的新路径。在利益衡量方法的司法适用中，法官所秉持的“经营者利益至上”的利益衡量评判理念存在偏失，同时缺少具体方法来规范与指引利益衡量。对此，应确立实现社会整体利益最大化的利益衡量评判理念，同时引入比例原则。经利益衡量，“优酷诉猎豹不正当竞争纠纷案”中涉及的屏蔽视频广告行为构成不正当竞争。In judging the legitimacy of video ad-blocking behavior, the judicial path which tries to determine businesse thics has never given detailed argument. The method of interest balancing may be the new path to judge the legitimacy of video ad-blocking behavior, because it emphasizes the substantive judgment of the facts of the case, which may effectively make up the legal loopholes, and it is more operable in the application. In the judicial application ofinterest balancing, there exist errors in the concept of interest balancing that operator interests are considered first, and there lack specific methods to regulate the activities of interest balancing. Focusing on these issues, judges shall establish the ideal devoted to maximizing the overall interests of society. Besides, judges can introduce the principle of proportion to constrain judges’ discretion. Through interest balancing, the behavior of video ad-blocking in “Youku v cheetahs” constitutes unfair competition.
