On the Construction of ＂Cooperative Protection＂ Mechanism of Underwater Cultural Heritage in the Disputed Waters in the South China Sea

南海作为海上丝绸之路南海航线的必经海域，蕴藏着丰富的水下文化遗产。因各种非法打捞或海上建设活动的影响，南海水下文化遗产正遭受严重破坏。南海特别是存在多国主张重叠的争议海域的水下文化遗产，难以通过一国单独行动获得有效保护。中国与东盟国家构建南海争议海域水下文化遗产“合作保护”机制既具备基础条件，也符合国际趋势，是一种可行的保护路径。现阶段，中国与东盟国家可以采取如下措施构建“合作保护”新机制：签署《南海水下文化遗产合作保护协定》；开展南海水下文化遗产专项普查；建立南海水下文化遗产上报制度；推动南海水下考古工作站及博物馆建设。The South China Sea is the compulsory waters along the South China Sea route in the maritime Silk Road, which is rich in underwater cultural heritage. However, various kinds of illegal salvage or construction ac- tivities in the sea have been affecting and severely damaging underwater cultural heritage in the South China Sea. And it is difficult for a single country to effectively protect underwater cultural heritage in the South China Sea, particularly over the disputed waters that are claimed to be overlapped by a few countries. There exist the basic conditions for China and ASEAN countries to build a ＂cooperative protection＂ mechanism for underwater cultural heritage in the disputed waters of the South China Sea, which conforms to the international trends and is a viable protection path. At present, China and ASEAN countries are suggested to take such measures as signing The A- greement of Cooperative Protection of Underwater Cultural Heritage in the South China Sea, carrying out the spe- cial survey over underwater cultural heritage in the South China Sea, setting up a system of reporting underwater cultural heritage in the South China Sea, and promote the construction of underwater archaeological workstations and museums in the South China Sea.
