dc.description.abstract台湾地区“司法改革”的模式及“政党再轮替”后台湾地区“司法权”的变化应予重视。历任台湾地区领导人均提出过司法政策论述,蔡英文的司法论述在内容上回应现实问题,并提出了“‘总统,领导司法改革”的司法改革组织模式。“‘总统’领导司法改革”的司法改革组织模式受制于台湾地区领导人的权限,“民主正当性”、“院际调解权”、“司法独立”等理论与规范为支持者与反对者提供了强弱不等的法理依据。台湾地区“司法改革”的新模式将引发台湾的司法决策中心转移和司法改革资源汇流,进而影响到“司法权”的未来运行。
dc.description.abstractNew method of judicial reform and judiciary change after party alternation should not be neglected. Every leader of Taiwan region proposed judicial policy, as well as Tsai Ing-wen, whose judicial reform platform advanced to response to social problems, in method so-called "president-lead-judicial-reform". The limited power of "president" and other legal issues, such as mediation power, judicial independence, have great influence to "president-lead-judicial-reform." Tsai Ing-wen's method of judicial reform may centralize judicial decision-making power and eliminate differences among judicial-reform-related groups.
