On the Application of Employment Prohibition System in Public Hazards Crime

2015年8月29日通过的《刑法修正案(九)》增设了禁止从事相关职业的规定,以环境、食品和药品三大领域为主的公害犯罪具有适用从业禁止制度的必要性。在公害犯罪领域,从业禁止规定的适用主体仅包括自然人,但实际上没有理由将单位排除在外。具体适用时,应在准确认定是否"利用职业便利"或"违背职业要求的特定义务"的基础上,以相应犯罪侵害法益的关联性为基准判断原特定职业与禁止从事职业的相关性程度。此外,还需注意从业禁止制度与禁止令的区别及配合适用。＂Criminal Law Amendment （9）＂, which was adopted on August 29, 2015, sets forth provisions on the employment prohibition system. The three areas of the environment, food and medicine-based public hazards crime have the necessity of applying the employment prohibition system. In the area of public hazards crime, the applicable subjects of the employment prohibition system include not only natural persons but also entities. In specific applications, we should ascertain whether the ＂use of professional convenience＂ or ＂breach of the specific obligations of professional requirements＂ has occurred, on the basis of occupational relations to determine the relevance of the specific occupation and prohibition occupation. In addition, we should pay due attention to the distinction and coordination between the employment prohibition system and the injunctions.
