Investor-State Arbitration Mechanism in Sino-foreign Investment Agreement under the “Belt and Road” Initiative
国际投资协定中的投资者—国家仲裁机制在我国＂一带一路＂倡议的实施中应居于重要地位。一方面,＂一带一路＂沿线国的中国投资面临着真实的投资风险;另一方面,近年来以＂一带一路＂沿线国为被申请方的投资仲裁呈上升趋势,这一现实表明,中国海外投资在＂一带一路＂沿线国也可能面临类似的投资措施和投资争议。然而,中国与＂一带一路＂沿线国的投资者—国家仲裁机制却存在着缺位与不足的问题。为了保护中国投资者在＂一带一路＂沿线国的合法和正当权益,需要考虑设立和加强中国与＂一带一路＂沿线国之间的投资者—国家仲裁机制。Investor-State arbitration mechanism under the international investment agreement should play an important role in the implementation of the ＂Belt and Road＂（ BR） Initiative. On the one hand,Chinese outward investments are facing real risks in the States along the BR. On the other hand,the increasing investment arbitrations in which the countries along the BR as respondent states in recent years also remind China of the investment risks. In other word,Chinese overseas investments may face similar investment measures and disputes. However,the investor-State arbitration,mechanism is absent or inadequate between China and States along the BR. Therefore,it is necessary to consider how to build and enhance the investor-State arbitration mechanism so as to protect the legal and legitimate rights of Chinese outward investors and their investments in States along the BR.
