On Delegating Remand Authority to WTO Appellate Body

WTO上诉机构的建立揭开了国际司法制度史上的崭新一页 ,对于整个争端解决机制的维护与发展具有深远的意义。然而 ,该上诉机构却缺乏通常上诉机构所拥有的一项重要权力———发回重审权。该权力的欠缺并非是无足轻重的 ,它已经引起了理论和实践中的某些混乱。为此 ,国际社会应对WTO上诉机制予以重新关注 ,并应尽快地赋予其发回重审权以切实维护所有WTO成员国的共同利益The establishment of the WTO Appellate Body (AB) turns over a new page in the international judicial system. It is of far reaching significance to the maintenance and development of the whole Dispute Settlement Mechanism. This Appellate Body, however, lacks one of the most important powers that appellate bodies possess-the Remand Authority. Such deficiency is not smalltime and has already caused chaos in some areas chaos. Hence the international society should again show solicitude for the Dispute Settlement Mechanism and delegate the Remand Authority to the AB as soon as possible.Thus, the common interests of all the member countries of the WTO will be safeguarded.
