The Study of Application of the “Foreign Law Clause” under South Africa Constitution

It makes South Africa access to foreign law and international law, and promotes the values that underlie an open and democratic society based on human dignity, equality and freedom. The Constitutional Court of South Africa cites the foreign law in a very wide range of cited countries. The means of interpreting“ foreign law” mainly includes literal, historical, systematical, intentional and comparative interpretation. The context of citing mainly includes cases, legislation, legal facts, legal doctrine,the opinion of judges and legislative documents. The modes of citing mainly include the mode of statement, the mode of experience and the mode of tool. Therefore, the application of“ foreign law clause” means the process of legal reference and interpretation in essence, rather than the process of politics. It promotes the development and perfection of South Africa legal system. It strengthens the independence of South Africa Constitution.
