The Prosecutors’ Role and Function of Public Interest
【中文摘要】检察官署代表国家为刑罚权的发动，重在维护社会秩序与公共利益，并及保障个人基本权利。司法审判程序，可能侵夺人民的身体、自由、财产、名誉甚至生命。对人民而言，程序保障的需求乃格外热切，为确保人权，必须课予发动刑罚之国家公权机关有践行正当法律程序之义务。正当程序需要组织与程序制度的配合。欧陆法系思维赋予检察官以司法官定位，进而衍生检察官的客观中立义务。检察官中立角色的扮演，涉及检察官职权行使的程序设计。理论界提出的犯罪控制模式及正当程序模式从不同维度影响着检察官的公益角色。 【Abstract】Prosecutors can initiate punitive power on behalf of the country. They focus on protecting social order and public interest as well as guarding personal fundamental rights. Judicial trials may infringe people's rights of body, liberty, property, reputation, and even life. Therefore, the importance of procedural protection cannot be emphasized more. In order to ensure human rights, authorities that can initiate punitive power have the duty to practice due process, which requires the well-established mechanism to support. In European, prosecutors and judges are parallel judicial branches. That leads to the neutral obligation of prosecutors. The prosecutors’ neutral role in the judicial mechanism is related to the procedural design of prosecutorial power.The crime control model and the due process model describe different roles of prosecutors in public interest.
