On the Application of the Principle of Legal Reservation in the Field of Organizational Law

【中文摘要】组织法律保留概念在理论上具有相对的独立性。随着现代国家的发展，侵权概念和自由概念的扩张使法律保留原则延伸至组织法领域。德国、日本和我国台湾地区公法学虽然均承认组织法律保留的正当性，但是其态度存在一定的差异。虽然组织法律保留的适用可以参照法律保留的判断基准，但是组织法和行为法的差异决定了法律保留原则在组织法领域中适用的独特性。我国大陆地区公法学虽然引入了法律保留学说来说明宪法和法律中的有关问题，但是关于组织法律保留的研究并不系统。这就需要拓展组织法律保留研究的空间，使法律保留原则在组织法领域中得到有效适用。 【Abstract】The concept of reservation about organizational law has relative independence in theory. With the development of the modern country, the extension of the concept of tort and the expansion of the concept of freedom makes the principle of legal reservation extend to the field of organizational law. In Germany, Japan and Taiwan in China, although the science of public law has recognized the legitimacy of the reservation about organizational law, but it has some differences in attitude. Although the applicable benchmark of reservation about organizational law can refer to the legal reservations, but due to differences in the organizational law and the behavior law determines the principle of legal reservation has its own unique in the organizational law. Although the science of public law in the mainland of China has introduced the theory of legal reservation to study the relevant problems of the constitution and law, but the research on the principle of reservation about organizational law is not systematic. This needs to expand the research space about the reservation of organizational law, so that the principle of legal reservation can be applied effectively in the field of organization law.
