On the New Practice of the “TRIPS-Plus” Obligations in China's Free Trade Agreements

【中文摘要】后 TRIPS 时代,美欧强势推行“超 TRIPS”知识产权规则,学界多持批判态度。中国新近与若干较发达国家间缔结的自由贸易协定的知识产权章,则呈现出对超 TRIPS 义务的逐步接受趋势,突出体现在所并入的国际公约、权利保护类型、邻接权保护标准、电子和数字技术应用、执行措施等方面。外部动因与内部动因导致了中国对超 TRIPS 义务的态度嬗变,而自身条件变化这一内因是其根本原因。在当前国内重视创新驱动、对外推行“一带一路”战略的新形势下,中国对超 TRIPS 义务应具体鉴别,为我所用,以加强国际经贸规则的中国话语权,推进有利于自身的国际知识产权规则的形成。 【Abstract】 In the post-TRIPS era, the US and the EU are aggressively promoting “TRIPS-plus” intellectual property rules, towards which academia used to hold a critical attitude. Intellectual property chapters in the free trade agreements that China has recently concluded with some relatively developed countries demonstrate a gradual acceptance of TRIPS-plus obligations, notably in international conventions incorporated, types of rights protected, protection standards on neighboring rights, electronic and digital technology application and enforcement measures. External and internal causes has led to the change of China's attitude towards TRIPS-plus obligations, while the internal causes – the changes of China's own conditions – are fundamental. At present, with the domestic emphasis of being “innovation-driven” and the overseas implementation of the “Belt and Road Initiative”, China should conduct specific appraisals of TRIPS-plus obligations and make good use of them, so as to strengthen the nation's discourse power over international economic and trade rules and promote the formation of international intellectual property rules favorable to China.
