乡约、习惯法与闽南乡土社会

Abstract

描述明清时期乡约制度在闽南乡土社会发生的若干状况、闽南乡土社会关于乡约“合理词讼“及其适用的民间习惯法的历史记录和历史记忆。可以看出,“闽南乡土社会“是一个宽泛的概念,泛指闽南文化覆盖的闽、台等地的闽南语方言区之乡村社会。

This article traces the development of rural communal conventions in Southern Fujian in the Ming and Qing Dynasties, the history of rural convention of rendering "reasonable verdict by the Patriarchal Clan" and the related customary law applicable in the rural community of Southern Fujian.Results show that the term "Rural Community in Southern Fujian" was used in a very broad sense then, referring to communities of both Southern Fujian and Taiwan which share the same Southern Fujian dialect and local culture.
